These Terms and Conditions ("Terms") govern your use of paintedweb.com (the "Site") and your interactions with PaintedWeb, a service of Painted Web LLC ("PaintedWeb," "we," "us," or "our"). By using this Site or submitting an inquiry through it, you agree to these Terms. If you do not agree, please do not use the Site.
PaintedWeb is operated by Painted Web LLC, a Pennsylvania limited liability company, located at 3217 Fox Hill Road, Easton, PA 18045. We design and build websites and related digital marketing and automation services for small businesses.
Content on this Site, including service descriptions, concept designs, and pricing references, is provided for informational purposes only and does not constitute a binding offer. A project begins only once we've agreed on scope, price, and timeline in a separate written agreement or invoice signed or accepted by both parties.
Submitting the contact form or otherwise reaching out does not create a client relationship or any obligation on either side, and does not by itself enroll you in text messaging. We aim to respond within 24 hours. If you separately check a text-message consent box on our contact form, you agree to be contacted by text as described in our Privacy Policy, which also governs how we handle information you share with us.
Where these Terms don't address a specific point of an active project, such as payment schedule, revision rounds, content deadlines, or ongoing support, the written agreement for that project controls. In general:
Our Care Plan (ongoing hosting, edits, and monitoring) requires a 3-month minimum commitment from the plan's start date. After the initial 3 months, the plan continues on a month-to-month basis until canceled. You may cancel at any time by giving 30 days' written notice to [email protected]; the plan stays active, and billing continues, through the end of that notice period.
You own the website files and content created specifically for you once your project is paid in full or, for Care Plan clients, once your Care Plan ends in good standing. On departure, we'll provide a static export of your website (HTML/CSS/JS, no backend dependencies) for a one-time site export fee of $20, covering the time to prepare and package it.
From that point forward, hosting, domain/DNS management, and any contact-form backend are your responsibility. You're free to host the export anywhere, though reconnecting forms or integrations elsewhere may require a developer. If you'd rather have our help moving the site to a new host or platform instead of self-hosting the export, we offer paid migration assistance for a $20 migration fee.
PaintedWeb retains the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing. Third-party assets we license on your behalf (fonts, stock imagery, software subscriptions) remain subject to their own licenses.
Some tools we use to run your Care Plan are part of PaintedWeb's own platform and are not included in your site export:
If you opt in to text messages from PaintedWeb by separately checking a consent box on our contact form, you may receive messages related to your inquiry, project, or, if you separately opted in, marketing updates. Consent to receive text messages is optional and is never a condition of submitting a form, engaging our services, or making a purchase. Message frequency, opt-out instructions, and how we handle SMS data are described in full in our Privacy Policy.
Delivering our services may involve third-party platforms, including hosting providers, domain registrars, scheduling tools, payment processors, and marketing platforms such as Google or Meta. We are not responsible for the availability, performance, or policies of these third-party services. Where you maintain your own accounts with such platforms (for example, an advertising account you fund directly), you are responsible for that account and its terms.
We build sites and systems designed to perform well, and we're honest about what's realistic. We do not guarantee specific outcomes such as search rankings, lead volume, or revenue, since these depend on factors outside our control, including market conditions, your business's own responsiveness, and decisions made by third-party platforms.
To the fullest extent permitted by law, PaintedWeb and Painted Web LLC will not be liable for indirect, incidental, or consequential damages arising from your use of the Site or our services. Our total liability for any claim relating to a project is limited to the amount you paid us for that project.
We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
